These Terms of Service ("Terms") govern your access to and use of ThalosForge Inc.'s ("ThalosForge," "we," "us," or "our") services, including our API, SDK, RTL IP, and related documentation (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
ThalosForge provides the Autonomous Thinker Accelerator (ATA), a decision-making engine for autonomous systems. Our Services include:

Rate Limits: Your plan determines your rate limits. Exceeding limits may result in throttling or suspension.
API Keys: Keep your API keys confidential. We may revoke keys that are compromised or misused.
Availability: We target 99.9% uptime but do not guarantee uninterrupted access. See our SLA for details.
Our IP: ThalosForge owns all rights to the Services, including algorithms, source code, RTL designs, documentation, and trademarks.
Your Data: You retain ownership of data you submit. You grant us a license to process your data to provide the Services.
Feedback: Any feedback you provide may be used by us without obligation to you.
If you license our RTL IP, additional terms apply:
Billing: Subscription fees are billed in advance. Usage-based fees are billed monthly in arrears.
Taxes: Prices exclude taxes. You are responsible for applicable taxes.
Refunds: Subscription fees are non-refundable except as required by law.
Price Changes: We may change prices with 30 days notice.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Safety-Critical Use: While ATA is designed for safety-critical applications, YOU are responsible for validating and certifying the system for your specific use case. We do not guarantee certification compliance.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THALOSFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless ThalosForge from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
By You: You may terminate your account at any time.
By Us: We may suspend or terminate your access for violation of these Terms or for any reason with 30 days notice.
Effect: Upon termination, your right to use the Services ends. Sections 5, 8, 9, 10, and 13 survive termination.
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance.
Governing Law: These Terms are governed by the laws of Virginia, USA.
Disputes: Any disputes shall be resolved through binding arbitration in Virginia, USA.
Entire Agreement: These Terms constitute the entire agreement between you and ThalosForge regarding the Services.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
Waiver: Failure to enforce any right does not waive that right.
